TERMS OF USE

Welcome to SagpanSetu.com. In order to use the SagpanSetu.com Site ("Site"), you must register as a member of the Site ("Member") and agree to be bound by these Terms of Use ("Agreement").

If you wish to become a Member, communicate with other Members and make use of the services provided by SagpanSetu.com ("Service"), please read these Terms of Use carefully and follow the instructions during the registration process.

This Agreement sets out the legally binding terms governing your membership and use of the Site and Service.

SagpanSetu.com may modify these Terms of Use from time to time. Whenever there is a change in the Terms of Use, SagpanSetu.com may notify Members through the Site, email or other appropriate means. Your continued use of the Site after such changes become effective shall constitute acceptance of the revised Terms.

1. Eligibility

You must be at least 18 years of age or older to register as a Member of SagpanSetu.com or use this Site.

Membership to the Site is void where prohibited by applicable law.

By using this Site, you represent and warrant that you have the right, authority and legal capacity to enter into this Agreement and to comply with all applicable laws and these Terms.

SagpanSetu.com is intended for individuals seeking lawful matrimonial relationships. The Site is not intended to encourage or promote illicit sexual relationships, extramarital affairs or any unlawful activity.

If SagpanSetu.com discovers or becomes aware that a Member is using the Site to promote, facilitate or engage in illicit sexual relationships, extramarital affairs, fraudulent activities or other unlawful conduct, SagpanSetu.com may suspend or terminate the Member's membership without refund, subject to applicable law.

The decision of SagpanSetu.com regarding suspension or termination shall be final, subject to applicable law.

2. Term

This Agreement will remain in full force and effect while you use the Site and/or remain a Member of SagpanSetu.com.

You may terminate your membership at any time by informing SagpanSetu.com in writing.

Termination of membership by a Member does not automatically entitle the Member to a refund of any unused or unutilized subscription fees, except where otherwise required by applicable law or expressly provided under the applicable subscription terms.

SagpanSetu.com may suspend, restrict or terminate your access to the Site and/or your membership if:

• You breach these Terms;
• You provide false, misleading or fraudulent information;
• You misuse the Site or information belonging to another Member;
• You engage in harassment, abuse, fraud or unlawful activity;
• You attempt to misuse or circumvent Site security or restrictions; or
• SagpanSetu.com reasonably believes that such action is necessary to protect the Site or its Members.

Where appropriate, SagpanSetu.com may notify you of termination through the email address, mobile number or other contact information provided by you.

If SagpanSetu.com terminates your membership because you have breached this Agreement, you will generally not be entitled to a refund of unused subscription fees, subject to applicable law.

Certain provisions of this Agreement, including provisions relating to intellectual property, privacy, disclaimers, limitation of liability, disputes and indemnity, shall survive termination.

3. Non-Commercial Use by Members

The SagpanSetu.com Site is intended for the personal use of individual Members for legitimate matrimonial purposes.

The Site and Service may not be used in connection with unauthorized commercial activities.

Members may not:

• Advertise products or services;
• Solicit other Members for business purposes;
• Promote competing matrimonial or commercial services;
• Collect Member information for commercial purposes;
• Sell or distribute Member information; or
• Use the Service for unauthorized marketing or promotional activities.

Organizations, companies and businesses may not register as individual matrimonial Members or use the Service for unauthorized commercial purposes.

Illegal or unauthorized use of the Site, including unauthorized framing, scraping, automated extraction or linking, may be investigated and may result in appropriate legal action.

4. Other Terms of Use by Members

Members agree to use SagpanSetu.com responsibly and respectfully.

You may not:

• Engage in advertising to, or solicitation of, other Members to buy or sell products or services through the Service;
• Send chain letters, junk email, spam or unsolicited mass communications;
• Use information obtained from the Service to harass, abuse, threaten or harm another person;
• Contact, advertise to, solicit or sell to another Member without their prior explicit consent;
• Send messages that are obscene, lewd, defamatory, hateful, threatening, discriminatory or abusive;
• Impersonate another person;
• Create a fraudulent or misleading profile;
• Attempt to obtain unauthorized access to the Site, database or systems;
• Misuse another Member's personal information;
• Use automated processes, bots, crawlers, scripts or other programs to view, copy, collect or interact with Site content or Members;
• Attempt to bypass communication, search or contact limitations implemented by SagpanSetu.com; or
• Use the Site for any unlawful purpose.

In order to protect SagpanSetu.com and its Members from abuse, misuse, spam and automated activity, SagpanSetu.com reserves the right to restrict the number of searches, profile contacts, communications, responses, emails, chat sessions or other activities a Member may perform within a particular period.

SagpanSetu.com reserves the right to moderate, restrict, remove or delete messages, photographs, profiles or other content that violates these Terms or that it reasonably considers inappropriate, unlawful, misleading, abusive or harmful.

Member Content

You are solely responsible for the content and information ("Content") that you publish, display or transmit through the Site.

You represent that the information supplied by you is truthful and that you have the right to provide such information.

SagpanSetu.com does not guarantee the accuracy, completeness or authenticity of information supplied by Members.

5. Content Posted on the Site

The following is a partial list of Content that is illegal or prohibited on SagpanSetu.com.

SagpanSetu.com may investigate violations and may remove offending Content, suspend accounts or terminate memberships where appropriate and permitted by law.

Prohibited Content includes, but is not limited to, Content that:

• Harasses or advocates harassment of another person;
• Contains threats, intimidation, abuse, hate speech or defamatory material;
• Contains information that the person posting it knows to be false or materially misleading;
• Promotes illegal activities;
• Contains sexually explicit or pornographic material;
• Exploits or endangers persons under the age of 18;
• Infringes another person's copyright, trademark, privacy or other legal rights;
• Contains restricted or unauthorized access information;
• Attempts to obtain passwords, OTPs, financial information or personal identifying information for unlawful or unauthorized purposes;
• Contains viruses, malware or other harmful code;
• Promotes unauthorized commercial activities;
• Encourages or facilitates extramarital affairs;
• Attempts to defraud, deceive or financially exploit another Member; or
• Violates applicable law.

Profile Review and Activation

Newly created profiles may be checked for basic quality, completeness and compliance with SagpanSetu.com policies before or after activation.

SagpanSetu.com reserves the right to discontinue, deactivate, restrict or terminate a profile if its content, language, conduct or information is considered inappropriate, abusive, fraudulent, misleading, unlawful or otherwise unacceptable.

Accuracy of Profile Information

Every Member submitting a matrimonial profile is responsible for providing truthful, accurate and current information relevant to a prospective matrimonial relationship.

Members should not conceal material facts relevant to marriage.

SagpanSetu.com does not guarantee the genuineness, accuracy, completeness or current status of information provided by its Members.

Information regarding a Member's age, marital status, education, occupation, income, business, assets, family background, lifestyle, religion, community, location or any other personal information may be based solely on information provided or declared by that Member.

Members and their families are responsible for independently verifying information that they consider important before proceeding with an engagement, marriage or other commitment.

Identity Verification

SagpanSetu.com may verify the identity of Members through Aadhaar/e-Aadhaar using DigiLocker or an applicable authorized digital verification process, subject to applicable law, Member consent and technical availability.

Aadhaar identity verification may apply to all categories of Members, including Free Members, Regular/Paid Members and Elite Members.

Aadhaar identity verification is intended only to establish or assist in establishing the identity associated with the Member's account.

No Other Document Verification

SagpanSetu.com does not physically or digitally verify, certify or guarantee any documents or claims submitted, uploaded or declared by Members, except for the specific Aadhaar identity verification described above.

SagpanSetu.com does not verify or certify:

• Balance Sheets;
• Profit & Loss Statements;
• Income Tax Returns;
• Bank statements;
• Salary or income;
• Business turnover;
• Business ownership;
• Property or asset ownership;
• Educational certificates or degrees;
• Employment certificates or employment history;
• Professional qualifications;
• Professional licences;
• Family financial status;
• Financial assets or investments;
• Social or economic status; or
• Any other document or claim made by a Member.

Therefore, an Aadhaar-verified profile or an Elite membership must not be interpreted as verification or certification of the Member's financial, educational, professional, employment, business, family or other personal claims.

Elite Membership

Elite Membership is a membership category providing the features and benefits specified by SagpanSetu.com.

Elite Membership does not constitute comprehensive background verification or certification of the Member.

An Elite Member may have Aadhaar identity verification in the same manner as other membership categories.

Elite Membership does not mean that SagpanSetu.com has verified the Member's:

• Income;
• Salary;
• Financial position;
• Business;
• Business turnover;
• Employment;
• Educational qualifications;
• Professional qualifications;
• Property or assets;
• Family wealth;
• Family background;
• Character;
• Criminal background; or
• Any other claim contained in the matrimonial profile.

Members and their families must conduct their own appropriate due diligence before making any matrimonial or financial decision.

Member Responsibility

Members are solely responsible for the information they provide and for their interactions with other Members.

SagpanSetu.com shall not be responsible for incorrect, incomplete, outdated or misleading information supplied by Members.

Contact Information

Contact information of Members may be displayed according to the applicable membership plan and Site policies.

Free Membership may provide limited access to certain features. SagpanSetu.com reserves the right to modify, restrict, discontinue or change free features at any time, subject to applicable law.

Legal Eligibility for Marriage

Members agree that they are legally eligible to marry under applicable law.

SagpanSetu.com shall not be responsible for a Member's failure to comply with applicable legal requirements relating to marriage.

No Guarantee of Responses or Match

SagpanSetu.com cannot guarantee that a Member will receive responses, find a suitable match, enter into a relationship, become engaged or get married through the Site.

No refund or credit shall be due solely because a Member does not receive responses or does not find a suitable matrimonial match, except where otherwise required by applicable law or expressly provided under the applicable subscription terms.

Technical Delays

Members shall not have any claim against SagpanSetu.com for delays in posting, updating or displaying information due to technical, operational or other reasons.

SagpanSetu.com may delete, modify, reject or restrict any profile that it considers unsuitable, incomplete, misleading, unlawful or contrary to Site policies.

Member Conduct

SagpanSetu.com is not responsible for the conduct, intentions, identity, financial capacity, matrimonial intentions or personal circumstances of other Members.

6. Copyright Policy

You may not post, distribute, reproduce or otherwise use copyrighted material, trademarks or other proprietary information without obtaining the required permission from the owner of such rights.

SagpanSetu.com owns or has appropriate rights to its Site design, software, trademarks, logos, graphics, text and other proprietary materials.

Except for information that is publicly available or for which you have been expressly permitted to use, you may not copy, modify, publish, transmit, distribute, reproduce, display or sell such proprietary information.

Members retain ownership of their lawful personal content, subject to the rights necessary for SagpanSetu.com to operate and provide the Service.

By submitting photographs, profile information or other Content to SagpanSetu.com, you grant SagpanSetu.com the necessary non-exclusive permission to host, store, display and process such Content for operating and providing the Site and Service, subject to applicable law and the Privacy Policy.

SagpanSetu.com reserves the right to remove Content that violates these Terms or applicable law.

7. Member Disputes

You are solely responsible for your interactions with other SagpanSetu.com Members.

SagpanSetu.com reserves the right, but has no obligation, to monitor disputes between Members.

SagpanSetu.com is not a party to any matrimonial arrangement, engagement, marriage, financial transaction or personal relationship between Members.

Members are strongly advised to conduct independent due diligence before:

• Sharing sensitive personal information;
• Meeting another Member in person;
• Finalizing a matrimonial relationship;
• Making financial commitments;
• Sending money;
• Providing loans;
• Purchasing tickets or travel arrangements for another Member;
• Investing in any business; or
• Entering into any business or financial relationship.

Members should never send money to another Member merely because of an online matrimonial relationship or request.

Any fraud, suspicious activity, impersonation or misuse should be reported to SagpanSetu.com.

8. Privacy

Use of the SagpanSetu.com Site and/or Service is governed by the SagpanSetu.com Privacy Policy.

Where identity verification is performed using Aadhaar/e-Aadhaar, DigiLocker or another authorized digital verification mechanism, such verification shall be subject to applicable law, Member consent, the applicable verification process and the SagpanSetu.com Privacy Policy.

Members should not unnecessarily share sensitive personal information through their profile, chats or other communication channels.

Members are responsible for maintaining the confidentiality of their login credentials, passwords and OTPs.

9. Disclaimers

SagpanSetu.com is not responsible for any incorrect, inaccurate, incomplete, outdated or misleading Content posted on the Site or transmitted between Members.

SagpanSetu.com does not guarantee:

• The identity of every Member;
• The accuracy of every profile;
• The truthfulness of Member claims;
• The financial condition of any Member;
• The educational qualifications of any Member;
• The employment or professional status of any Member;
• The marital intentions of any Member;
• The family background of any Member;
• The compatibility of Members;
• The success of any matrimonial relationship; or
• Any specific result from using the Site or Service.

Aadhaar identity verification does not constitute comprehensive background verification.

An Aadhaar-verified profile does not mean that SagpanSetu.com has verified the Member's income, education, employment, business, property, financial position, family background, character or other profile claims.

Likewise, Elite Membership does not constitute comprehensive verification or certification of the Member or the information contained in the Member's profile.

The exchange of profiles through SagpanSetu.com should not be construed as an offer, recommendation, endorsement, guarantee or certification by SagpanSetu.com.

SagpanSetu.com shall not be responsible for any loss or damage arising from relationships, communications, transactions or arrangements established between Members.

The Site and Service are provided on an "AS IS" and "AS AVAILABLE" basis to the extent permitted by applicable law.

SagpanSetu.com does not guarantee uninterrupted availability of the Site or Service.

SagpanSetu.com is not responsible for errors, omissions, interruptions, delays, technical failures, server failures, Internet failures, unauthorized access, data transmission failures or other technical problems beyond its reasonable control.

SagpanSetu.com cannot guarantee and does not promise any specific matrimonial result from use of the Site or Service.

10. Limitation on Liability

Except where such limitations are restricted by applicable law, SagpanSetu.com shall not be liable for indirect, consequential, exemplary, incidental, special or punitive damages arising from your use of the Site or Service.

This includes losses arising from:

• Interactions with other Members;
• Matrimonial relationships;
• False or misleading information supplied by Members;
• Financial transactions between Members;
• Fraud or deception by Members;
• Failure to find a suitable matrimonial match;
• Technical interruptions;
• Unauthorized access; or
• Loss of data.

To the extent permitted by applicable law, SagpanSetu.com's total liability to a Member for any cause whatsoever shall be limited to the amount actually paid by that Member to SagpanSetu.com for the relevant Service during the applicable membership period.

Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.

11. Disputes

If there is any dispute about or involving the Site and/or the Service, your use of the Site constitutes your agreement that the dispute will be governed by the laws of India.

Subject to applicable law, you agree to the jurisdiction of the competent courts in Mumbai, Maharashtra, India.

12. Indemnity

You agree to indemnify and hold harmless SagpanSetu.com, its owners, directors, affiliates, officers, agents, employees, service providers and partners from any loss, liability, claim, demand, damage or reasonable legal expense arising from or relating to:

• Your use of the Service in violation of this Agreement;
• Your breach of these Terms;
• Content or information submitted by you;
• Your violation of another person's rights;
• Your unlawful conduct;
• Your interactions or transactions with another Member; or
• Your breach of any representation or warranty contained in these Terms.

OTHER TERMS

Communications

By becoming a Member of the SagpanSetu.com Service, you agree to receive necessary service-related communications from SagpanSetu.com, including account notifications, security notifications, subscription information and other communications required to operate the Service.

Promotional communications, where applicable, shall be subject to applicable law and user preferences.

Entire Agreement

This Agreement, together with the applicable Privacy Policy and other policies expressly incorporated into the Site, constitutes the entire agreement between you and SagpanSetu.com regarding your use of the Site and Service.

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Reporting Misuse or Abuse

You are encouraged to report any misuse, abuse, fraud, impersonation, harassment or violation of these Terms to SagpanSetu.com through the appropriate Customer Care or reporting channel.

Upon receiving a complaint, SagpanSetu.com may investigate and, where appropriate, suspend or terminate the membership of a Member responsible for the violation.

Members must provide truthful information when making complaints. Deliberately false or malicious complaints may result in appropriate action against the complainant.

Member Due Diligence

SagpanSetu.com is a matrimonial introduction and communication platform. It is not a substitute for personal, family, legal, financial, professional or other due diligence.

Before finalizing a matrimonial relationship, engagement or marriage, Members and their families are responsible for independently verifying any information they consider important.

In particular, Members and their families should independently verify financial, educational, professional, employment, business, family and marital information before making any important decision.
